These Terms of Service (“Terms”) govern your access to and use of the services provided by Best Boat Club & Rentals (hereinafter “we”, “our”, “us”, or “Company”) through the website at https://fortlauderdaleboatrentals.com (the “Site”) and the rental, membership, training, and other boating services provided by the Company (the “Services”). By using our Site or booking any of our Services, you agree to these Terms. If you do not agree, please do not use the Site or book any Services.

1. Services

1.1 We provide boat rental and boat club membership services located in Fort Lauderdale, Florida. Our Services include (but are not limited to) rental of vessels, membership access, boating training courses, and associated equipment provision. fortlauderdaleboatrentals.com+1
1.2 When you book a rental or membership, you agree to comply with all instructions, guidelines, and safety standards provided by the Company.
1.3 We reserve the right to refuse service or cancel a booking if you fail to meet eligibility requirements, act in a way that violates these Terms, or present a safety risk.

2. Eligibility & Requirements

2.1 You must be at least 22 years old to book a boat rental and to drive a vessel unless you hire an operator/captain. fortlauderdaleboatrentals.com+1
2.2 If you plan to operate the boat yourself, you must have the required boating experience: minimum 3 years for single-engine craft, and 5 years for twin-engine craft. Additionally, if you were born after January 1, 1988, you must hold a valid Florida boater license. fortlauderdaleboatrentals.com+1
2.3 You must present a valid photo ID, and any other documentation requested by us (e.g., proof of boating experience, license).
2.4 You are responsible for all persons in your party and must ensure they comply with safety rules and Company instructions.

3. Booking, Payments & Cancellations

3.1 Bookings may be made on the Site or by telephone. You must pay the full rental/membership fee in advance or as otherwise stated in the booking confirmation.
3.2 The price, duration, capacity and included items shall be as set out in your booking confirmation (“Booking”), and may include a boat, captain (if required), insurance, safety gear, and other amenities. Ft Lauderdale Boat Rental & Tours+1
3.3 Cancellations by you: You may cancel your Booking by providing notice as required by the applicable cancellation policy. If you cancel within the permitted timeframe, you may receive a full refund or credit as defined in the policy.
3.4 Cancellations by us: We may cancel your Booking in the event of unsafe weather, mechanical failure, or other unforeseen circumstances; in such cases, you will be offered a refund or re-booking option.
3.5 No-Shows: If you fail to attend at the scheduled departure time without canceling, you may be charged the full amount of the Booking.
3.6 Additional fees may apply if you exceed the booked duration, exceed the agreed number of guests, cause damage, or otherwise violate the terms of the Booking.

4. Use of Vessels and Equipment

4.1 You must operate the vessel safely, respectfully, and in compliance with all relevant laws, regulations and Company instructions.
4.2 Alcohol & drugs: You must not operate the vessel under the influence of alcohol, drugs or any impairing substance. You must follow any additional restrictions imposed by us.
4.3 You are responsible for the conduct of your party, and for any damage caused by your party’s negligence or wilful acts.
4.4 We reserve the right to terminate a rental early if we determine there is unsafe conduct, violation of rules, or you or your party are acting in a way that endangers others or property. No refund will be given in that event.
4.5 Rental duration: You must return the vessel at the agreed time and meeting point. Late returns may incur additional charges.

5. Safety, Liability & Insurance

5.1 We maintain insurance coverage for the vessels in accordance with industry standard, but you remain responsible for damages caused by your party’s negligence or misconduct.
5.2 You agree to release, waive and discharge the Company and its affiliates, employees, agents, officers from any liability, claim or cause of action arising out of your use of the Services, except in cases of the Company’s gross negligence or willful misconduct.
5.3 You agree to indemnify and hold the Company harmless from any claim, damage, loss or expense (including legal fees) arising out of your use of the Services, your breach of these Terms, or your violation of any applicable law.
5.4 THE COMPANY DOES NOT WARRANT THAT YOUR USE OF THE BOAT OR EQUIPMENT WILL BE UNINTERRUPTED OR ERROR-FREE. ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.
5.5 In jurisdictions where applicable law prohibits or limits the exclusion or limitation of certain warranties or liabilities, the Company’s liability shall be limited to the fullest extent permitted by law.

6. Intellectual Property

6.1 The Site, its content, branding, graphics, and media are the property of the Company or its licensors, and are protected by copyright, trademark and other intellectual property laws.
6.2 You may not reproduce, distribute, modify, or create derivative works of the Site content without our prior written permission.
6.3 You grant us a royalty-free, perpetual, transferable license to use any content (photos, videos, reviews) you submit via the Site or during your rental for marketing and promotional purposes.

7. Your Conduct

7.1 You agree not to engage in any unlawful, abusive or disruptive behavior.
7.2 You must not interfere with the Site or related networks, or attempt to gain unauthorised access to our systems.
7.3 We may suspend or terminate your booking or membership if you breach these Terms or your conduct creates risk to the Company or other persons.

8. Privacy & Data Protection

8.1 We will collect, use and store your personal information in accordance with our Privacy Policy (which is available on the Site). By using our Services you consent to such collection and use.
8.2 You are responsible for keeping your account credentials secure (if applicable) and for all activity that occurs under your account.

9. Memberships (if applicable)

9.1 If you purchase a membership package (boat-club membership), you agree to pay the dues, usage fees and any other obligations set out in the membership agreement.
9.2 Memberships are non-transferable unless otherwise agreed in writing.
9.3 We may suspend or terminate your membership for nonpayment, misconduct, or violation of the membership terms; you may forfeit any unused benefits in those cases.

10. Changes to Terms

10.1 We may revise these Terms from time to time. The updated Terms will be posted on the Site with the “Effective Date” updated. Your continued use of the Services after such posting constitutes your acceptance of the new Terms.
10.2 If you do not agree with the changes, you must stop using the Services and cancel any bookings.

11. Governing Law & Dispute Resolution

11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
11.2 Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in [Broward County, Florida].
11.3 If any provision of these Terms is found invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary so that the remaining Terms will continue in full force and effect.

12. Severability & Waiver

12.1 If we do not enforce any right or provision in these Terms, it does not constitute a waiver of our right to later enforce that right or provision.
12.2 If a court finds any part of these Terms invalid or unenforceable, the remaining portions shall remain in effect.
